installation is damage. Can't delete CASCRepair file

I tried several time to delete the CASCRepair.mrk file, but it keeps recreating itself, i know it is because it's Read-only, but the problem is that i can't make the folder Data(and its subfolders and files including CASCRep) not Read-only. I've googled it and it seems that is a problem with windows 7 (the fact that i can't turn read-only off) and i tried to set off the propriety with a command in CMD but for some reason the command does not work. so my question is: Is there any other possiblity ?
Note : I have the new launcher, not the old one

Did you download our torrent or install from battle.net? Or... do you have battle.net installed?

I downloaded it from the freakz torrent not from battlenet and yes I have battlenet installed.

I doubt you have our full client, but still. Having battlenet might affect it, someone said he did a battle.net scan/repair and got his client to work
